EU ETS Issue 118 - European Court of Justice Declares EU ETS Free Allocation for 2013-20 as Invalid

Following a series of legal challenges brought by a number of industrial EU ETS operators that have backfired, the European Court of Justice (ECJ) has ordered the European Commission to recalculate the EU Emissions Trading Scheme (EU ETS) free allocations to 2020. This is likely to cut the level of free allocation received and hence raise compliance costs for members; whilst also having potential implications for free allocation in EU ETS phase 4 (2021-30).  BCC EU ETS Issue 118 (available to members only) summarises the recent ruling and the associated implications.
